Terms of Service

These Terms of Service govern your access to and use of helloAISearch (the “Service”), operated by PulseSpark AI LLC, a Pennsylvania limited liability company. By creating an account, you agree to these Terms.

1. Who you're dealing with

References to “we,” “us,” or “helloAISearch” mean PulseSpark AI LLC. References to “you” mean the individual or entity that signs up for the Service.

2. The trial

Every new account starts with a 14-day free trial of the Studio plan with no credit card required. After day 14, scans pause until a payment method is added. Account data is retained for 60 days after trial expiration; if no payment method is added in that window, data is permanently deleted.

3. Subscriptions, billing, and refunds

Paid plans are billed monthly in advance via Stripe. Plans renew automatically until canceled. You can cancel at any time from Settings → Plan; cancellation takes effect at the end of the current billing period and you retain access through that date. We do not provide pro-rated refunds for partial months. If you believe you were charged in error, email billing@helloaisearch.com within 14 days and we'll review in good faith.

4. What we do with your data

We send the prompts you configure to ChatGPT, Claude, Gemini, and Perplexity on your behalf and store their responses so we can show you a feed and compute share-of-voice metrics. We never train AI models on your data, and we do not sell your data. See the Privacy Policy for the full picture, including sub-processors.

5. Acceptable use

Don't use the Service to monitor individuals (this is for brands — yours and your competitors'). Don't resell our LLM access. Don't attempt to reverse-engineer the Service, scrape non-public endpoints, or circumvent rate limits. Don't use the Service in violation of US export control laws or sanctions.

6. Service availability

We aim for 99.5% monthly uptime but make no formal SLA on the non-Agency tiers. AI engines are non-deterministic and occasionally rate-limit or error; missed scans are retried automatically. Don't make load-bearing business decisions on a single day's scan — that's why we built the trend lines and Today's Move.

7. Intellectual property

You retain all rights to the prompts, brand information, and content you put into the Service. We retain rights to the Service itself, including the share-of-voice computations, the Competitive Map, and the recommendations engine. You grant us a limited license to process your inputs to provide the Service.

8. Termination

We can suspend or terminate accounts that violate these Terms. You can terminate at any time by canceling your subscription and requesting account deletion. On termination, we begin the 60-day grace deletion process described above.

9. Liability

The Service is provided “as is.” To the maximum extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or lost-profits damages.

10. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Allegheny County, Pennsylvania.

11. Changes

We may update these Terms; material changes will be notified by email at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.
